Terms governing access to and use of KiwiMotion.ai and its AI generation services.

These Terms of Service govern your access to and use of KiwiMotion.ai, including our AI video, image, audio, voice, avatar, editing, enhancement, and related generation tools.

These Terms form a legally binding agreement between you and:

In these Terms, “KiwiMotion,” “we,” “us,” and “our” refer to SIA “Kiwimotion AI.” “You” and “your” refer to the person or organisation using the Service.

1. Acceptance of these Terms

By creating an account, purchasing a subscription or credits, clicking to accept these Terms, or otherwise using KiwiMotion.ai, you agree to these Terms and our Privacy Policy.

If you use KiwiMotion on behalf of a company or another organisation, you confirm that you have authority to bind that organisation to these Terms.

You must not use the Service if you do not agree to these Terms.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use KiwiMotion.

You must not use the Service where doing so would violate applicable laws, sanctions, export restrictions, or other legal requirements.

3. The KiwiMotion Service

KiwiMotion provides access to AI-powered tools that may include:

  • Text-to-video and image-to-video generation
  • Video editing, motion transfer, effects, and enhancement
  • Text-to-image generation and image editing
  • Avatar creation and talking avatars
  • Text-to-speech, voice design, and voice cloning
  • Background removal, upscaling, virtual try-on, and related tools

Some features are provided through third-party AI models and infrastructure providers. Available models, features, generation limits, processing times, resolutions, and supported formats may change.

AI generations are probabilistic. The same prompt may produce different results, and we do not guarantee that a generation will match your prompt exactly.

4. Accounts and account security

You must provide accurate account information and keep it current.

You are responsible for:

  • Protecting your login credentials
  • Activity performed through your account
  • Prompts, uploads, generations, downloads, and publications made through your account
  • Ensuring that anyone authorised to use your account complies with these Terms

You must promptly notify us at support@kiwimotion.ai if you believe your account has been accessed without permission.

You must not share an account to avoid usage limits, payment requirements, suspensions, or other restrictions.

5. Subscriptions, billing, and automatic renewal

KiwiMotion may offer monthly subscriptions, annual subscriptions, free access, trials, promotional credits, or other paid options.

The price, billing period, included credits, features, generation-history period, and applicable limitations are displayed on the Pricing page and during checkout. Those displayed terms form part of this agreement.

Unless stated otherwise during checkout:

  • Monthly subscriptions are charged monthly in advance.
  • Annual subscriptions are charged for the full year in advance.
  • Credits included with an annual subscription may be issued monthly, as displayed on the Pricing page.
  • Subscriptions automatically renew for the same billing period until cancelled.
  • Cancellation stops the next renewal and normally takes effect at the end of the current paid billing period.

Applicable taxes and the final amount payable will be displayed during checkout.

You authorise KiwiMotion and its payment processor to charge the payment method associated with your account for recurring subscription fees and applicable taxes.

If payment fails, we may retry the payment, restrict paid features, suspend the subscription, or cancel it after reasonable notice.

6. Credits

Generation costs vary depending on the selected model, duration, resolution, quality, and other settings. The applicable credit cost should be displayed before you submit a generation.

Credits:

  • Are linked to your KiwiMotion account
  • Are not legal tender or stored monetary value
  • Cannot be transferred, resold, or exchanged for cash
  • May be subject to allocation, rollover, or expiry rules displayed on the Pricing page or during checkout
  • May be removed if obtained through fraud, payment reversal, technical abuse, or violation of these Terms

We may change credit prices for future generations. A change will not alter the credit cost of a generation already accepted by our system.

Promotional or free credits may have additional limitations and may be changed or withdrawn.

7. Generation charges, background processing, and failures

Credits may be deducted when a generation request is accepted for processing.

Once a generation has been accepted and tracked, it may continue in the background even if you navigate away from the Studio or close your browser. Closing the page does not cancel an accepted generation.

Completed results and processing or failure information may appear in your private KiwiMotion Library.

When a generation fails because of a confirmed provider or KiwiMotion system error after credits were charged, we may automatically restore the charged credits to your account.

Restored credits are account credits and are not a cash refund.

Credits may not be restored where:

  • No credits were charged
  • The request was rejected before processing
  • The user intentionally violated these Terms or applicable provider safety rules
  • The generation was cancelled after processing began, where cancellation is available
  • Restoration would result in duplicate compensation for the same generation

Nothing in this section limits any refund or remedy required by applicable consumer law.

8. Cancellation, refunds, and consumer rights

You may cancel a subscription through your account or by contacting support. Cancellation normally prevents the next renewal but does not automatically refund the current billing period.

Except where required by law or expressly stated during checkout, paid subscription fees and used credits are non-refundable.

Consumers may have mandatory withdrawal, refund, conformity, repair, price-reduction, or termination rights under applicable law.

Where immediate access to a digital service or digital content is requested during a statutory withdrawal period, we may ask you to:

  • Expressly request that performance begins immediately
  • Acknowledge that you may be required to pay for service already provided
  • Acknowledge that your withdrawal right may be lost after digital content is supplied or the service is fully performed, where permitted by law

These Terms do not exclude or reduce any mandatory consumer rights.

To request cancellation, withdrawal, or another consumer remedy, contact support@kiwimotion.ai and include your account email and relevant payment information.

9. Your prompts, uploads, and other content

You retain any rights you hold in prompts, images, videos, audio, voice samples, and other material that you submit to KiwiMotion.

You confirm that:

  • You own the submitted material or have all necessary permissions to use it
  • Processing the material through KiwiMotion does not violate another person’s rights
  • You have obtained any required consent from people shown, heard, or identified in the material
  • Your content and intended use comply with applicable laws and these Terms

You grant KiwiMotion a limited, worldwide licence to host, copy, process, transmit, modify, and display your content only as reasonably necessary to:

  • Provide the requested generation or processing service
  • Store and display content in your private Library
  • Operate, secure, and troubleshoot the Service
  • Provide customer support
  • Prevent abuse and enforce these Terms
  • Comply with legal obligations

This licence ends when the content is no longer reasonably needed for those purposes, subject to backups, fraud prevention, dispute records, and legal retention obligations.

We do not acquire ownership of your uploads merely because you use the Service.

10. AI-generated outputs

As between you and KiwiMotion, you may use your generated outputs to the extent permitted by applicable law, these Terms, third-party rights, and any model-specific restrictions displayed in the Service.

KiwiMotion does not claim ownership of your outputs. To the extent KiwiMotion holds any rights in an output created specifically for you, we grant you a worldwide, royalty-free licence to use that output, subject to these Terms.

You understand that:

  • AI-generated material may not qualify for copyright or other exclusive protection
  • Similar or identical outputs may be generated for other users
  • Outputs may contain errors, artefacts, inaccuracies, unexpected material, or resemblance to existing works
  • KiwiMotion does not guarantee originality, exclusivity, legal protectability, or non-infringement
  • An output does not establish that you have permission to use another person’s name, image, likeness, voice, trademark, character, or copyrighted work

You are responsible for reviewing outputs and obtaining any necessary legal clearances before publication, advertising, sale, commercial use, or distribution.

11. Voice cloning, avatars, and real people

You may create or use a cloned voice, avatar, likeness, or representation of a real person only when you have that person’s valid authorisation or another lawful basis.

You must not use KiwiMotion to:

  • Impersonate another person deceptively
  • Commit fraud or identity theft
  • Create a false endorsement
  • Misrepresent that a person said or did something
  • Clone a person’s voice without permission
  • Create non-consensual intimate or sexual material
  • Exploit or endanger a child
  • Harass, threaten, defame, blackmail, or deceive another person

You are responsible for obtaining and retaining evidence of consent where appropriate.

We may request evidence of authorisation, restrict a generation, remove stored content, disable a cloned voice, or suspend an account when we reasonably believe a person’s identity, likeness, or voice is being misused.

12. AI-generated content disclosure

When you publish or distribute realistic AI-generated or manipulated image, video, or audio content, you must clearly disclose that the content is AI-generated or manipulated whenever required by applicable law, platform rules, advertising standards, or the context in which it is used.

This includes synthetic voices, avatars, deepfakes, and content that could reasonably be mistaken for an authentic recording or event.

You must not remove provenance information, safety metadata, labels, or watermarks where removal is prohibited by law or intended to facilitate deception.

13. Prohibited use

You must not use KiwiMotion to create, upload, process, store, or distribute content that:

  1. Violates any applicable law or regulation.
  2. Infringes copyright, trademark, privacy, publicity, data-protection, contractual, or other rights.
  3. Contains child sexual abuse material or sexually exploits, sexualises, grooms, or endangers a minor.
  4. Contains non-consensual intimate imagery or sexual content involving a person without valid consent.
  5. Facilitates fraud, scams, phishing, identity theft, deceptive impersonation, blackmail, or financial abuse.
  6. Promotes terrorism, violent extremism, serious violence, or instructions intended to cause physical harm.
  7. Unlawfully threatens, harasses, stalks, defames, or targets a person or protected group.
  8. Is designed to suppress voting, impersonate election authorities, or deceptively manipulate an election.
  9. Contains malware, malicious code, credential theft, unauthorised surveillance, or instructions for cyber abuse.
  10. Uses biometric, voice, facial, or other personal data unlawfully.
  11. Is used as the sole basis for high-impact medical, legal, financial, insurance, employment, education, housing, law-enforcement, or similar decisions concerning a person.
  12. Circumvents safety controls, usage limits, authentication, payment systems, or technical restrictions.
  13. Scrapes, reverse engineers, attacks, overloads, probes, or interferes with the Service or its providers.
  14. Resells or provides unauthorised access to KiwiMotion accounts, credits, or infrastructure.
  15. Falsely represents that AI-generated content was created, approved, or endorsed by KiwiMotion or another person.

Creative, fictional, journalistic, educational, documentary, or satirical context does not remove your obligation to comply with the law and respect third-party rights.

14. Content moderation and enforcement

We may use automated systems, provider safety systems, and human review to detect suspected violations, respond to reports, protect users, and comply with legal obligations.

We may:

  • Refuse or block a generation
  • Restrict access to particular models or features
  • Remove or disable stored content
  • Suspend or terminate an account
  • Preserve relevant evidence
  • Report conduct to competent authorities where legally required or reasonably necessary to address serious harm

Where reasonably possible and legally permitted, we will provide the affected user with information about the restriction and an opportunity to request review.

We are not required to pre-approve every generation or actively monitor all user content.

15. Reporting illegal or rights-infringing content

To report suspected illegal content, intellectual-property infringement, impersonation, privacy violations, or abuse, contact support@kiwimotion.ai.

A report should include:

  • Your name and contact information
  • A clear description of the content or conduct
  • The relevant Library item, generation, account, or other identifying information
  • The legal or rights-based reason for the report
  • Supporting evidence
  • A statement that the report is accurate and submitted in good faith

We may request additional information before acting.

Knowingly submitting false or abusive reports may violate these Terms.

16. Private Library and storage

Your KiwiMotion Library is intended as temporary product storage, not permanent backup or archival storage.

Generation history and stored media are scheduled for automatic deletion after the period displayed for your plan and described in our Privacy Policy.

Content may be removed earlier when:

  • You delete it
  • You close your account
  • Your subscription or applicable storage period ends
  • The content violates these Terms
  • Removal is required for security, operational, or legal reasons
  • A third-party provider removes or invalidates the underlying file

You are responsible for downloading and securely storing outputs that you wish to keep.

We do not guarantee permanent availability of Library items or third-party media links.

17. Third-party providers

KiwiMotion relies on third-party providers for AI generation, hosting, storage, authentication, email delivery, payments, analytics, and other infrastructure.

Your content may be transmitted to such providers as necessary to deliver the requested service and as described in our Privacy Policy.

Third-party providers may impose technical limits, safety rules, downtime, or model-specific restrictions. We do not control their systems and cannot guarantee uninterrupted availability of any particular model.

Where mandatory law applies, this section does not remove KiwiMotion’s responsibility to provide a conforming digital service.

18. Service availability and changes

We may update, replace, suspend, limit, or discontinue models and features for reasons including:

  • Security and abuse prevention
  • Legal or regulatory compliance
  • Provider availability
  • Technical maintenance
  • Product improvement
  • Cost or capacity changes
  • Model retirement
  • Protection of users or third parties

We will try to provide reasonable notice where a change materially affects an ongoing paid service.

Where required by consumer law, a material negative modification may give you the right to terminate the affected service without additional charge.

Unless a separate written service-level agreement applies, we do not guarantee a particular uptime, processing time, queue time, or generation speed.

19. Beta and experimental features

Features marked beta, preview, experimental, early access, or similar may be incomplete, unstable, or changed without notice.

You should not rely on experimental features for critical, safety-sensitive, or time-sensitive work.

20. Intellectual property in KiwiMotion

KiwiMotion and its licensors retain all rights in the Service, including its software, interface, branding, logos, documentation, designs, databases, and underlying technology.

We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Service according to these Terms.

You may not copy, modify, sell, sublicense, reverse engineer, or commercially exploit the Service except where expressly authorised or where such restriction is prohibited by law.

If you provide feedback or suggestions, you grant us permission to use them without payment or obligation to you.

21. Privacy

Our processing of personal data is described in the KiwiMotion Privacy Policy.

You must not submit another person’s personal data, biometric information, image, voice, or likeness unless you have a lawful basis and have provided any legally required notices.

22. Warranty disclaimer

To the maximum extent permitted by law, KiwiMotion is provided on an “as is” and “as available” basis.

AI outputs may be incomplete, inaccurate, unexpected, offensive, unsuitable, or legally restricted.

KiwiMotion does not warrant that:

  • Every generation will succeed
  • Outputs will satisfy your intended purpose
  • Outputs will be original or exclusive
  • Outputs will not resemble third-party material
  • The Service will always be uninterrupted or error-free
  • A particular model will remain available
  • Stored content will remain available indefinitely

KiwiMotion is not a substitute for professional legal, medical, financial, safety, or other regulated advice.

Nothing in these Terms excludes warranties, conformity rights, remedies, or protections that cannot lawfully be excluded for consumers.

23. Limitation of liability

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability for intentional misconduct, fraud, or death or personal injury caused by negligence where applicable.

For consumers, KiwiMotion remains responsible to the extent required by mandatory consumer law.

For business users, to the maximum extent permitted by law:

  • KiwiMotion is not liable for indirect, incidental, special, consequential, or lost-profit damages.
  • KiwiMotion is not liable for loss caused by unlawful user content, failure to download outputs, third-party rights claims arising from user instructions, or use of an output without appropriate review.
  • KiwiMotion’s total aggregate liability arising from the Service will not exceed the amount the business user paid to KiwiMotion during the 12 months immediately preceding the event giving rise to the claim.

These limitations apply only to the extent permitted by applicable law.

24. Business-user indemnity

If you use KiwiMotion for business or professional purposes, you agree to defend and indemnify KiwiMotion against third-party claims, losses, and reasonable costs arising from:

  • Your prompts, uploads, or published outputs
  • Your violation of another person’s rights
  • Your unlawful or prohibited use of the Service
  • Your breach of these Terms

This section does not apply to the extent a claim was caused by KiwiMotion’s own unlawful conduct.

25. Suspension and termination

You may stop using the Service at any time and may request account deletion according to the available account controls and Privacy Policy.

We may restrict, suspend, or terminate access when reasonably necessary because of:

  • A serious or repeated breach of these Terms
  • Fraud, payment abuse, or chargeback abuse
  • Security risks
  • Illegal activity
  • Misuse of another person’s identity, likeness, or voice
  • A valid legal order
  • Risk of serious harm to KiwiMotion, users, providers, or third parties

Where appropriate, we may give you notice and an opportunity to correct the issue.

Immediate action may be taken for serious violations, fraud, security incidents, child-safety concerns, or legal obligations.

After termination, your right to use the Service ends. Content and unused credits may be removed or expire subject to the Pricing page, Privacy Policy, these Terms, and mandatory law.

Sections intended by their nature to survive termination will remain effective.

26. Changes to these Terms

We may update these Terms for legal, security, technical, provider, or product reasons.

Material changes will be communicated through the Service, by email, or by another reasonable method before they take effect where required.

Changes apply prospectively from their stated effective date. They do not remove mandatory rights that already apply to you.

If you do not agree to updated Terms, you must stop using the Service and cancel any renewal before the updated Terms take effect.

27. Complaints and dispute resolution

Please contact support@kiwimotion.ai first so that we can attempt to resolve a complaint directly.

Include:

  • Your name and account email
  • A description of the issue
  • Relevant payment or generation information
  • The resolution you are requesting

Where Latvian consumer law applies, we will provide a response or proposed solution within the period required by applicable law.

If a consumer dispute cannot be resolved directly, eligible consumers may contact the Latvian Consumer Rights Protection Centre or seek available out-of-court dispute resolution through the Consumer Dispute Resolution Commission.

28. Governing law and courts

These Terms are governed by the laws of the Republic of Latvia.

If you are a consumer, this choice of law does not deprive you of mandatory protections available under the law of your country of residence.

You may bring claims in any court available to you under applicable consumer law.

For business users, disputes that cannot be resolved informally will be submitted to the competent courts of Latvia, unless otherwise agreed in writing.

29. General provisions

If any part of these Terms is found unenforceable, the remaining provisions will continue to apply.

Failure to enforce a provision is not a waiver of that provision.

You may not transfer your agreement or account without our permission.

We may transfer these Terms as part of a merger, restructuring, sale of business, or similar transaction, subject to applicable law.

These Terms, the Privacy Policy, the Pricing page, checkout information, and any applicable model-specific rules form the complete agreement concerning the Service.

Electronic notices and agreements have the same effect as written communications where permitted by law.

If these Terms are translated, the English version governs only to the extent permitted by mandatory consumer law.
